The most common question we get is what a simple will costs. Everyone wants to know the price before they make the call or provide any information. The problem in answering that question is that when it comes to estate planning, one size does not fit all. Depending on the complexity of your assets (large estate, business ownership, real estate owned in other states or countries) and family dynamics (blended families, children from previous marriages, minor children, special needs children) a simple will might not accomplish what you need it to do.
Simple Will Package: A simple will works well for single individuals or those that are married without minor children. A simple will package, which includes a Last Will and Testament, Personal Property Memorandum, General Durable Power of Attorney, Medical Power of Attorney, Advanced Directive (living will), and Disposition of Last Remains, is $1,850 for an individual and $2,650 for a couple.
Complete Family Will Package: The family will package is for individuals and couples with minor children. A family will package, which includes a Last Will & Testament with Contingent Trust for children, a Personal Property Memorandum, the Nomination of Guardian for Minor Child, General Durable Power of Attorney, Medical Power of Attorney, Advanced Directive (Living Will), and Disposition of Last Remains, for each spouse, is $2,650 for an individual and $3,250 for a couple.
Living Trust Package: The living trust package will avoid probate because your assets are owned by the trust and held by the trustee. A trust can provide privacy and protection of your assets for your beneficiaries and allow you to have your assets distributed over time. The living trust package which includes the Revocable Living Trust Agreement, Funding Memorandum, Statement of Authority, Pourover Will, Nomination of Guardian for Minor Child (if necessary), General Durable Power of Attorney, Medical Power of Attorney, Advanced Directive (Living Will), and Disposition of Last Remains is $3,600 for an individual and $4,600 for a couple.
Deeds: Deed preparation and recording services are available for the transfer of properties, or the future transfer of property, located in Colorado. Beneficiary deeds, warranty deeds, special warranty deeds, personal representative’s deeds, trustee’s deeds are $550, plus the recording fees.
Individual Documents: An individual legal document, such as a power of attorney, medical power of attorney or advanced directive / living will, is $350 per document. If two our more individual documents are requested, the second and subsequent documents are reduced to $200. For college students or young adults, the fee for both a power of attorney and medical power of attorney is $500.
Marital Agreements: Marital agreements are $750-$1,125 based on the time involved.
Updates and Amendments: Werth Law offers a free 3-year review for all clients to review their plan, and discuss their choices of fiduciaries, the distribution plan, and updates in the law. For changes and amendments to plans drafted by Werth Law, we offer the following pricing: quick fix is $750, a refresh of the estate plan is $1,475, and to do major rework to the plan is $2,150.
